The Peoples Democratic Party (PDP) in Edo state has gone to court to challenge the amendment by the state House of Assembly abridging the mandatory 90 days notice for polls by the constitution in the conduct of local government elections.
The Edo State Independent Electoral Commission (EDSIEC) had last week fixed February 3 for the conduct of the LG election in the state.
Speaking to newsmen on Thursday, the state chairman of the party, Dan Orbih, said the notice given by EDSIEC fell short of the 90 days required by the constitution.
He said: “We want the court to decide whether the State House of Assembly can validly amend the Local Government Law to bridge the time on notice of poll stated in Section 30(1) of the Electoral Act 2010 as amended, having regards to paragraphs 11 and 12 of part 2 schedule of the 1999 Constitution as amended.”
