The Kaduna State House of Assembly and the state Attorney General have asked the Federal High Court sitting in Kaduna to dismiss the suit filed by former Governor Nasir El-Rufai, challenging the report of the Ad-Hoc Committee that indicted him in an alleged N423 billion fraud. The respondents argued that the court lacks jurisdiction to adjudicate on the matter and that El-Rufai’s suit is speculative and lacks cause of action.
At the court sitting, counsel for the respondents, Femi Falana (SAN) and Sule Shuaibu (SAN), adopted their respective processes and prayed the court to dismiss the suit. They also argued that El-Rufai did not bring the report of the Kaduna State House of Assembly before the court, which he sought to declare as unconstitutional, null and void.
The presiding judge, Justice Rilwan M. Aikawa, reserved judgement in the suit, with a date for judgement to be communicated to the parties involved. El-Rufai had filed the fundamental rights case in June 2024, challenging the report on grounds that it did not give him a fair hearing during its sitting.
