Ismaila Mustapha popularly known as Mompha has filed a lawsuit against the Economic and Financial Crimes Commission (EFCC) over unlawful detention.
Okay.ng understands that the Instagram celebrity dragged the anti-graft agency to a Lagos High Court for violating his fundamental rights.
Mompha in the application dated November 14 filed by his lawyers, including Gboyega Oyewole (SAN), Ademola Adefolaju, Kolawole Salami, and four others, asked the court to declare his continued detention since October 22 unlawful and constitutes a gross violation of his right to personal liberty.
Mustapha is demanding the sum of N5 million as damages from the EFCC and also court order directing the commission to release him unconditionally forthwith from its custody.
He also wants the court to declare that the failure of the EFCC to charge and arraign him in court is unconstitutional.
He is therefore seeking an order of the court directing the EFCC to release him from custody, unconditionally.
He is also seeking an order of perpetual injunction restraining the EFCC or any person acting on its behalf from arresting and detaining him in relation to the subject matter of this suit without recourse to the due process of law.
It can be recalled that Mompha was arrested on October 18 at the Abuja airport while on his way to Dubai.
